I often receive calls from potential clients or loved ones of current clients that their spouse, boyfriend, friend, cousin has just been arrested because the person missed two child support payments and they need to have the person released from jail. On the other hand, I have consultations throughout the week where people have court orders to see their children and when the custodial parent does not show up or refuses parenting time, the Judge does little to nothing. This must end. It is critical to be as aggressive as the probation department is to collect the child support when it comes to your parenting time. If you are not aggressive, the custodial parent will keep defying the court order and ruining your relationship with your child, which is child abuse in my eyes. I totally agree that child support payments need to be made on time and/or consistently and if you cannot afford the amount, file to have it lowered. You can try to do it alone, or you can gather the money to hire an experienced family law litigator to help your situation. However, if you do miss child support payments, you still are entitled to see your child, especially if you have court ordered parenting time. Never, Never give up on your parenting time and your parental rights, your child needs to know you, needs to have both parents in his or her life.
